1. Who We Are and What This Policy Covers

Elite Childcare Consulting ("we", "us", "our") is a Hong Kong–based childcare consultancy. This Privacy Policy explains how we collect, use, store and protect your personal data when you use any of the following websites and services (together, the "Elite family"):

By using any of these websites or services, or by submitting your personal data to us, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please do not use our websites or provide us with your personal data.

2. What Personal Data We Collect

We collect only the personal data we need to provide our services. Depending on how you interact with us, this may include:

  • Contact details — your name, email address and telephone number, provided when you complete a contact or enquiry form, subscribe to our newsletter, or otherwise contact us.

  • Messages and enquiry content — the content of messages you send us via contact forms, email, phone or messaging services, which may include information about your family and childcare needs.

  • Service information — information reasonably required to deliver the service you have engaged us for, such as details of your household, children's ages and care requirements, or (for training candidates) employment and qualification details.

  • Course and account data — if you enrol in one of our courses, your name, email address, course enrolment, progress and completion records, held on the Thinkific platform.

  • Payment information — payments are processed by secure third-party payment processors. We do not receive or store your full card details.

  • Technical data — standard information collected automatically when you visit our websites, such as IP address, browser type, device information and pages visited (see Section 8, Cookies).

We ask that you do not send us sensitive personal data (for example, health or medical information) unless it is necessary for the service you are requesting — such as care arrangements for a child with medical needs — in which case it will be handled with additional care and used solely for that purpose.

3. Children's Personal Data

As a childcare consultancy, parents and guardians may share information about their children with us (such as names, ages, routines and care needs) so that we can deliver our services. This information is provided by, and with the consent of, the parent or guardian, is treated as strictly confidential, is used only for the purpose of delivering the requested service, and is never used for marketing. Our websites, newsletters and courses are directed at adults, and we do not knowingly collect personal data directly from children. If you believe a child has provided us with personal data directly, please contact us and we will delete it.

4. How We Use Your Personal Data

We use your personal data only for the following purposes:

  • To respond to your enquiries and provide the advice or information you have requested;

  • To deliver the services you have engaged us for, including consultations, placements, training and courses;

  • To send you our newsletter and updates, where you have subscribed or otherwise consented to receive them;

  • To administer course enrolments, track progress and issue certificates where applicable;

  • To maintain our business records, and to comply with legal, regulatory and accounting obligations; and

  • To operate, secure and improve our websites.

We will not use your personal data for any purpose unrelated to the purpose for which it was collected without first obtaining your consent.

5. Direct Marketing

We will only send you marketing communications — such as our newsletter, course announcements and service updates — where you have subscribed or consented to receive them, in accordance with the Personal Data (Privacy) Ordinance. Every marketing email we send includes an unsubscribe link, and you may opt out at any time, free of charge, by using that link or by contacting us at the address in Section 12. Opting out of marketing will not affect any services you receive from us.

6. Who We Share Your Data With

We do not sell, rent or trade your personal data, and we do not share it with third parties for their own marketing purposes. Your data is shared only in the following limited circumstances:

  • Service providers acting on our behalf — we use carefully selected third-party providers to operate our business, including our website hosting providers, Thinkific (course hosting), Flodesk (email newsletters) and payment processors. These providers process your data only on our instructions and for the purposes described in this policy, and are bound by their own contractual and legal obligations to protect it.

  • Legal and regulatory requirements — we may disclose personal data where required to do so by law, or in response to a lawful request from a government authority, regulator, law enforcement agency or court.

  • With your consent — for example, where you ask us to share your details with a family or candidate as part of a placement.

7. International Data Transfers

Some of our service providers, including Thinkific and Flodesk, store and process data on servers located outside Hong Kong (including in North America and the European Union). Where your data is transferred outside Hong Kong, we take reasonable steps to ensure it receives a level of protection consistent with this policy and applicable law, including relying on the safeguards and data processing commitments offered by these providers.

8. Cookies

Our websites use cookies and similar technologies. Cookies are small text files stored on your device that help our websites function properly and help us understand how visitors use them. We use:

  • Essential cookies — required for the websites to operate (for example, security and page functionality). These cannot be switched off.

  • Analytics and performance cookies — which help us understand how visitors use our sites so we can improve them. Where required by law, these are used only with your consent.

You can control or delete cookies through your browser settings at any time. Please note that disabling cookies may affect the functionality of parts of our websites. Third-party platforms we use (such as Thinkific and Flodesk) may set their own cookies, which are governed by their respective privacy and cookie policies.

9. Data Retention

We retain personal data only for as long as is necessary to fulfil the purpose for which it was collected, and thereafter as required for legitimate business, legal, accounting or regulatory purposes. As a general guide:

  • Enquiries that do not lead to a service — retained for up to [12] months from our last contact with you, then deleted.

  • Client and service records — retained for up to [7] years after the service ends, in line with legal and accounting requirements in Hong Kong.

  • Newsletter subscriptions — retained until you unsubscribe, after which your details are removed from our mailing list.

  • Course records — retained while your course account is active and for a reasonable period thereafter, so that certificates and records of completion remain available.

When personal data is no longer required, it is securely deleted or anonymised. Data held in backups is deleted in line with our routine backup cycles.

10. How We Protect Your Data

We take reasonable and appropriate technical and organisational measures to protect personal data against unauthorised or accidental access, processing, erasure, loss or use. Access to personal data is limited to those who need it to deliver our services. While we work hard to protect your data, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. In the unlikely event of a data breach affecting your personal data, we will act promptly and in accordance with applicable law and the guidance of the Office of the Privacy Commissioner for Personal Data.

11. Your Rights

Under Hong Kong law (PDPO): We comply with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong ("PDPO"), including its six Data Protection Principles. Under the PDPO you have the right to request access to the personal data we hold about you, and to request the correction of any personal data that is inaccurate. We may charge a reasonable fee for processing a data access request, as permitted by the PDPO.

For clients in the EU and UK (GDPR / UK GDPR): If you are located in the European Union or the United Kingdom, you may have additional rights under the General Data Protection Regulation or UK GDPR. These include the rights to access your personal data; to have it corrected or erased; to restrict or object to its processing; to data portability; and to withdraw consent at any time where our processing is based on consent. Where we process your data, we do so on the basis of your consent, the performance of a contract with you, our legitimate interests in operating our business, or compliance with legal obligations. You also have the right to lodge a complaint with your local supervisory authority.
